§ 1 Subject matter of the contract

Pullop operates a web interface accessible via desktop PCs or mobile phones through https://pullop.com, facilitating the coordination of roadside assistance from various service providers. Pullop solely serves as a platform operator and does not directly provide roadside assistance services. Our role entails connecting users with cross-border support, ensuring prompt assistance during roadside breakdowns. These General Terms and Conditions govern the contractual relationship between users (clients) and service providers within our platform.

§ 2  Registration on the platform

Users are required to register on the Pullop platform, providing personal information and creating an account with a unique email and password combination. It is the user's responsibility to safeguard their account credentials to prevent unauthorized access. Furthermore, accounts are strictly designated for individual use and may not be shared or utilized by any other party.

§ 3 Requesting Assistance

When requesting assistance through Pullop, users are prompted to fill out a comprehensive form detailing their name, location, reason for assistance, vehicle type, and any pertinent information. For non-members, a service fee is indicated during the request process, which must be settled before assistance is dispatched. Upon verification of the request, qualified service providers are mobilized to provide timely assistance. Users can track the progress of their assistance request in real-time using our platform, ensuring transparency throughout the process. It's essential to note that additional fees may apply, depending on the nature of services rendered by the third-party provider, and users are obligated to fulfill such payments promptly.

§ 3 Membership subscription

1. Pullop membership subscription entails certain eligibility criteria, including a minimum age requirement of 18 years and adherence to a one-account-per-user policy. Membership spans a duration of one year, automatically renewing unless canceled by the user. Users retain the prerogative to cancel their membership at any time, subject to the terms outlined herein. Furthermore, refund requests, excluding applicable fees, are accommodated within the first 30 days of subscription, contingent upon the submission of a support ticket.

2. Membership with Pullop confers upon members a reimbursement of expenses commencing at 10% of the initial roadside assistance cost for personal vehicles under 3.5 tonnes and 6% for vehicles exceeding 3.5 tonnes. Additionally, each consecutive year of membership with Pullop entitles the member to an automatic increment of 5% (for vehicles under 3.5 tonnes) and 2.7% (for vehicles exceeding 3.5 tonnes) in reimbursement. It is pertinent to note that the accumulation percentage is applicable only if the member abstains from requesting roadside assistance during the respective membership year.

§ 4 Service providers

Service providers seeking registration on the Pullop platform must comply with all relevant local laws and regulations governing their operations. Transparency is paramount, necessitating clear disclosure of service tariffs to users prior to engagement. By maintaining adherence to legal standards and fostering transparent communication, service providers contribute to the efficacy and reliability of the Pullop platform.

§ 5 Customer support

Pullop provides comprehensive customer support exclusively through our designated support system. While our primary languages of communication include English, French, and Italian, we are committed to addressing inquiries and concerns in a timely manner, ensuring customer satisfaction. Responses to customer queries are typically provided within 48 hours, barring any exceptional circumstances beyond our control.

§ 6 Disclaimer of warranty

Pullop operates under the understanding that the provision of roadside assistance is subject to various factors, including external conditions and the availability of service providers. While we strive to facilitate prompt assistance to all users, unforeseen circumstances may impact the delivery of services. As such, Pullop disclaims any warranties, whether express or implied, regarding the uninterrupted availability or quality of roadside assistance services.

§ 7 Prohibited Behavior

The integrity and functionality of the Pullop platform rely on user compliance with prescribed usage guidelines. Prohibited behaviors include but are not limited to scraping of website content, activities that impede platform functionality, and reverse engineering of proprietary features. Users are expected to conduct themselves in a manner that upholds the integrity and functionality of the Pullop platform, in accordance with the terms delineated herein.

§ 8 Limitation of liability

Pullop operates with due diligence to ensure the reliability and efficacy of our platform; however, we cannot assume liability for circumstances beyond our control. While we strive to facilitate seamless roadside assistance experiences, users acknowledge and accept that Pullop's liability is limited to the scope of services provided within our platform.

§ 9 Online-dispute resolution

In the event of disputes arising between users and service providers, Pullop endeavors to facilitate amicable resolutions through online dispute resolution mechanisms. Our aim is to foster transparent communication and equitable outcomes, promoting the interests of all parties involved.

§ 10 GTC Subject to modification

These General Terms and Conditions are subject to periodic review and modification by Pullop, reflecting evolving regulatory requirements and operational considerations. Users will be duly informed of any amendments to these terms, ensuring transparency and compliance with regulatory standards.

§ 11 Closing provision

By accessing and utilizing the Pullop platform, users agree to abide by the terms and conditions outlined herein. These provisions govern the contractual relationship between users and Pullop, delineating rights, responsibilities, and obligations in the pursuit of seamless roadside assistance services.
